The Position – Compliance Director, Money Laundering Reporting Officer (MLRO) and Data Protection Officer (DPO)
The purpose of the role is to work with the business and peers within the compliance function to ensure that regulatory matters are managed in a professional manner by providing support and advice. The successful applicant for this position will be responsible for the compliance function within Apex Fund Services (Brasil) Ltda.
Responsibilities
- Liaising with the Head of Compliance – Americas to implement, maintain and monitor adherence with the Compliance framework for the Apex Brasil operations
- Providing compliance leadership and guidance to management and relevant staff
- The Compliance Director is responsible for ensuring that the company's operations and commercial transactions comply with relevant legal and internal rules. Key responsibilities include:
- Directing activities to ensure compliance with ethical and regulatory standards in financial institutions.
- Implementing processes to verify compliance with laws, regulatory agency standards, and internal and external regulations imposed on the institution's activities.
- Developing compliance training.
- Complying with legislation and National Financial System (SFN) standards.
- Participating in meetings with the institution's senior management, discussing the goals and integrated set of actions included in the strategic plan.
- Writing, updating, and deciding on policies and procedures to be adopted in the compliance area and by the institution.
- Ensuring regulatory updates on a monthly basis and where required based on changes in regulations affecting the provided services
- Proactively identify situations that may pose significant compliance risk and guide management in the development/review of applicable policies, procedures and business practices in coordination with Group policies and procedures
- Providing advice and training on anti-money laundering, sanctions and privacy matters and performs the role of MLRO, including carrying out AML risk assessments
- Working actively with the Head of Compliance - Americas to ensure delivery and completion of the annual Compliance Monitoring Plan and supporting key areas of compliance risk are executed on a timely basis
- Oversight of day-to-day AML tasks, as applicable: reporting, liaising with law enforcement agencies and other external authorities
- Suspicious transaction monitoring and reporting to the relevant local authorities
- Preparing reports for the regulator(s) and maintaining an open and positive working relationship with them, as applicable
- Ensure all employees are aware of and understand their compliance responsibilities including board members. Providing and organising compliance training for staff in coordination with the Head of Compliance – Americas and Group
- Implementation of regulatory implications of new product launches and service extensions
Qualifications
The successful candidate will have a minimum of 3-4 years of prior experience in the compliance area of a financial institution. The candidate should be skilled in Microsoft Office, prepared to learn other software and systems used in the fund accounting business to conduct AML/CFT reviews of clients and investors.
