Guernsey – Head of Compliance

Role Summary

The Guernsey Head of Compliance will act as the Compliance lead for the Guernsey-based Apex Group entities covering both Regulatory Compliance and Financial Crime Compliance. The role holder will assume a number of prescribed roles (MLRO/MLCO) and will be responsible for the Compliance functions in each entity and across each business line, reporting to Group as appropriate.

Key Responsibilities

• To promote an efficient and effective approach to managing Regulatory and Financial Crime Compliance- and regulatory-related tasks across the Apex Group in Guernsey;

• Maintain all applicable Compliance and Financial Crime Compliance-related policies and policy guidance and ensure appropriate review schedule; Prepare and deliver Compliance and FCC reports to Group, Senior Executives and Boards as required;

• Promoting a culture of compliance and adherence to applicable rules and standards across the Campus;

• Providing an escalation point for disclosures, concerns and unusual activity; • Designing and ensuring delivery of appropriate staff training and awareness, promoting high staff completion rates across the location;

• Own the preparation, maintenance and deliver of materials relating to regulatory matters, including thematic inspections;

• Own relevant KPIs across the Apex Group’s 1st and 2nd lines of defence, seeking to address any deficiencies in a timely manner;

• Own an effective Compliance Monitoring Program; promoting a consistent Guernsey approach and standard where possible;

• Monitoring adoption of, and compliance with, relevant legislation and local requirements;

• Ensuring robust data privacy controls are in place and that the Compliance function has processes in place to manage local incidents, per the relevant Group Policy;

• Own the overall relationship of the Apex Group with the Guernsey Financial Services Commission;

Other Responsibilities

• Assisting with other duties to support the Group and Regional Compliance functions as may be necessary from time to time;

• Positive engagement with Risk, Legal, IT and business departments to ensure Group and local issues are being effectively dealt with and progressed through to completion;

• Overseeing the closure of Internal Audit and External Audit action items as relevant;

• Attending Board Meetings, Risk Committee and GARCC meetings as required; • Ensuring there are adequate processes in place for monitoring and testing the effectiveness of systems and controls;

• Contributing to IT and system initiatives and projects which may impact the Compliance Framework;

• Maintaining an open dialogue and channel of communication with regional/jurisdictional Compliance staff;

• Support the Regional and Global Head of Compliance with general Compliance-, regulatory- and Financial Crime related matters;

• Keep up to date with developments in relevant laws, regulations and best practices;

• Providing advice and direction to support planned acquisitions and mergers;

• Contributing to various working group and steering committees;

• Sharing concerns or identified deficiencies to senior executives as appropriate;

• Contributing to the creation of a culture of risk awareness and the highest standards of corporate governance; and

• Reviewing new product and business initiatives and evaluate the impact on the relevant risks. Values and Behaviours

Skills and Experience

Candidates will have financial sector experience and a good understanding of, and experience with, performing Compliance/AML/CTF/PF roles and will have:

• A minimum of 10 year’s of experience in a senior regulatory/compliance role with at least 3 year’s experience of managing Regulatory and Financial Crime teams at a regulated financial services firm;

• Five year’s experience holding prescribed or regulated roles (e.g. MLRO/MLCO/CO) at a regulated financial services firm;

• Sufficient seniority and gravitas to discuss relevant topics at the most senior levels of the Group;

• Sound knowledge of, and experience with, regulatory interactions;

• A sound knowledge of relevant laws and standards;

• Awareness of Compliance staff obligations and those of the relevant persons under the applicable, local standards; and

• Highly developed communication skills with the ability to engage and build relationships at all levels, both internally and externally
